Maryland Vehicle Smoking Rules

Smoking is limited in vehicles in Maryland.


More laws are being put into effect to prohibit smoking in specific places for public health reasons. Maryland bars people from smoking in their vehicles under certain situations.


Company Vehicles


Maryland prohibits smoking in vehicles owned by a company and used for company business. The law previously barred smoking when more than one employee was in the vehicle, but was extended to include lone occupants. Violators can be ticketed and fined, and their company will be notified.


Kids in the Car


As of 2009, pending Maryland legislation would ban smoking in vehicles when children under age 8 are present, with a $50 fine for each violation. Opponents say the measure would restrict personal freedom; supporters say it would keep kids from being exposed to harmful secondhand smoke.


Cigarette Litter


Because of pollution and fire concerns, Maryland has also increased fines for those who toss cigarette butts out of their cars. Motorists and passengers are advised to use the ashtrays in their vehicles.
